1. Introduction and Acceptance

These Terms of Service ("Terms") govern your access to and use of the websites, apps, and services provided by domkaspot (collectively, the "Services"). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.

2. Who We Are

domkaspot ("domkaspot", "we", "us"). Our principal place of business is Warsaw, Poland.

3. Eligibility

You must be at least 18 years old and have the legal capacity to enter into a binding agreement to use the Services.

4. Accounts and Security

You are responsible for your account credentials and all activity under your account. Notify us immediately of any unauthorized use. You agree to keep your information accurate and up to date.

5. Platform Role

domkaspot operates a platform that enables users to create, browse, and interact with property listings and roommate profiles. Unless explicitly stated, we do not own, manage, or control listings, are not a party to rental agreements, and do not act as a real estate broker or insurer. We do not guarantee the accuracy of any listing or user content.

6. Listings, Interactions, and Transactions

• Users must provide accurate, lawful, and non-misleading information.
• Users are solely responsible for their communications and any agreements they enter.
• We may remove or disable content that violates these Terms or applicable law.

7. Fees and Payments

We may charge fees for certain features or services. If applicable, fees will be disclosed before purchase and are non-refundable unless required by law. You are responsible for any taxes that apply to your use of paid features.

8. User Content and License

You retain ownership of content you submit ("User Content"). You grant domkaspot a worldwide, non-exclusive, royalty-free license to host, store, reproduce, modify, adapt, publish, translate, and display your User Content for the purpose of operating and improving the Services. You represent you have all rights necessary to grant this license and that your content complies with law and these Terms.

9. Acceptable Use

• Do not violate laws or third-party rights.
• Do not post false, discriminatory, harassing, or harmful content.
• Do not attempt to access accounts or systems without authorization.
• Do not scrape, crawl, or use automated means except as permitted by us.

10. Reviews and Ratings

Reviews must be fair, accurate, and based on genuine experiences. We may remove reviews that are abusive, irrelevant, or fraudulent.

11. Intellectual Property

The Services, including the site, apps, logos, and content (excluding User Content), are owned by domkaspot or its licensors and are protected by law. You may not copy, modify, distribute, or create derivative works without our prior written consent.

12. Third-Party Services

The Services may link to or integrate with third-party services. We are not responsible for third-party services and your use of them is at your own risk and subject to their terms and policies.

13. Disclaimers

The Services are provided "as is" and "as available" without warranties of any kind, express or implied. To the extent permitted by law, we disclaim all warranties, including merchantability, fitness for a particular purpose, and non-infringement.

14. Limitation of Liability

To the maximum extent permitted by law, domkaspot will not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from or related to your use of the Services. Our aggregate liability for any claim shall not exceed the greater of PLN 1,000 or the amounts paid by you to us for the Services in the 12 months preceding the event.

15. Indemnification

You agree to defend, indemnify, and hold harmless domkaspot, its affiliates, and their directors, officers, employees, and agents from any claims, liabilities, damages, losses, and expenses arising from your use of the Services or your breach of these Terms.

16. Suspension and Termination

We may suspend or terminate your access to the Services at any time, with or without notice, if we reasonably believe you have violated these Terms or applicable law, or to protect the Services or other users.

17. Governing Law and Dispute Resolution

These Terms are governed by the laws of Poland, without regard to conflict of law principles. Courts in Warsaw, Poland shall have exclusive jurisdiction, except that consumers may have mandatory rights to bring claims in their country of residence under applicable law.

18. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will post the updated Terms and update the "Last updated" date above. Your continued use of the Services after changes become effective constitutes acceptance.
